Architects & Engineers (A&E) liability insurance is a type of Errors & Omissions policy that covers claims for potential damages relating to mistakes or negligent acts in the performance of their professional services. This can encompass construction delays, structural damages, design flaws, failure to meet contractual obligations, restitution and more. Policies can also include coverage for claims of bodily injury or property damage due to errors in their profession.
From solo practices to large firms, all architects and engineers are exposed to potential claims of negligence or errors. This policy can cover landscape architects, construction managers, technical consultants, process engineers as well as others. Claims can be quite complex and even though there may not be fault by the Insured, the defense can be costly. Although not every state requires professional liability, often federal law requires coverage on government contracts. Coverage may also be required by clients of the Insured.
An A&E policy can cover a range of risks from structural flaws to defending licensing proceedings. If a client or former client believes that an individual or business has caused financial or reputational harm, they may file legal action. Coverage can protect from cost of claims that are expensive and potentially career altering.
Both licensed and non-licensed individuals, professional and design firms are all eligible for coverage. Coverage may be needed for a specific client or project which can also be written.
These policies can be structured to best meet the needs of the person or entity. The needs of each Insured are evaluated to ensure they are properly covered. Coverages that can be negotiated are:
